Welcome to Protrain! By using our platform, you agree to these Terms of Use, which constitute a legally binding agreement between you and Protrain. Please read them carefully.
Use of the Service
Protrain is a social platform for athletes, coaches and sports enthusiasts to connect with other athletes, coaches and sports enthusiasts and showcase and discover talents in the form of short form videos. By using our service, you agree to:
- Provide accurate information about yourself and your sports preferences
- Respect the intellectual property rights of others
- Not use the service to harass, defame, or harm others
- Not use the service to distribute spam or other unsolicited messages
Unless otherwise noted during Your purchase of the Protrain Service You choose, as required by applicable law in Your jurisdiction, or as set forth in the refund policy applicable to any Protrain Service You purchase through a third-party marketplace, should You become dissatisfied with the Protrain Service You may deactivate Your Protrain Account via the Protrain.com Settings page at any time, and You will not be charged again for it in the future. You will retain access for the duration of the membership period You paid for. Full or partial refunds are not available for memberships purchased. If the Company determines that You are abusing our refund policy, we reserve the right to suspend or terminate Your account and refuse or restrict any and all current or future use of the Service without delivering a refund.
If You select a Protrain Service with an auto-renewal feature (“Recurring Subscription”), You authorize the Company to maintain Your Protrain Account information and charge that account automatically upon the renewal of the Protrain Service You choose with no further action required by You. In the event that the Company is unable to charge Your account as authorized by You when You enrolled in a Recurring Subscription, the Company may, in its sole discretion: (i) bill You for the Protrain Service and suspend Your access to the Protrain Service until payment is received, and/or (ii) seek to update Your Account information through third party sources (i.e., Your bank or a payment processor) to continue charging Your Account as authorized by You.
Payments are nonrefundable, and there are no refunds or credits for partially used periods. You may cancel a Recurring Subscription at any time, but if You cancel Your subscription before the end of the current subscription period, we will not refund any subscription fees already paid to us. Following any cancellation, however, You will continue to have access to the Protrain Service through the end of Your current subscription period (subject to Your continued compliance with the Terms of Use and if Your Account remains active). At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our users (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle You to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
If You purchase any Protrain Service through a mobile purchase or third-party marketplace (e.g., through the Apple App Store or Google Play Store), the refund policy applicable to that third-party marketplace will apply, unless otherwise explicitly stated by the Company. Except as otherwise explicitly stated by the Company, the third-party marketplace will be solely responsible for making refunds under its refund policy, and the Company will have no refund obligations. The Company disclaims any responsibility or liability related to any third-party marketplace's refund policy or the third party's compliance or noncompliance with such policy.
You can cancel your Protrain subscription by going to your Settings when logged into your Protrain account. Click on the settings icon, where you will find the 'Cancel Subscription' option. Follow the prompts to confirm the cancellation.
Privacy Policy
Protrain respects your privacy and is committed to protecting your personal information. Please review our Privacy Policy to understand how we collect, use, and disclose your information.
Intellectual Property
Protrain respects the intellectual property rights of others and expects our users to do the same. Please do not use our service to distribute copyrighted materials without permission.
Disclaimer of Warranties
Protrain provides our service on an "as is" and "as available" basis, without warranties of any kind, express or implied.
Limitation of Liability
Protrain will not be liable for any damages arising from the use of our service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Governing Law and Jurisdiction
These Terms of Use will be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the federal and state courts located in the United States of America.
Modification of Terms of Use
Protrain may modify these Terms of Use at any time. We will notify you of any changes by posting the revised Terms of Use on our website. Your continued use of our service after the posting of the revised Terms of Use constitutes your agreement to the revised Terms of Use.
